A big issue with the cap that I believe would be found unconstitutional by at least the US Supreme Court is that it fluctuates but leaves teams no recourse to correct their payrolls. It forces teams to negotiate with players under what will be false circumstances. Any year in which the cap goes down a team should be afforded buyouts. That way the player doesn't get completely screwed and a team can make up for the fact that the rules changed retroactively. Fire Bettman NOW!!! It's not like the NHL changed the rules AFTER the deal. They were already in place...to keep teams from circumventing the cap by adding bogus year at the end of an older players contract to lessen the cap hit. Flyers tried it and got burned.
