    Again as has been mentioned elsewhere....  I don't believe this case would never had been reopened UNLESS the prosecuting attorney feels they have strong enough evidence (based on the wording of the Assistant Crown attorney) that could bring about a possible conviction of one or all the players involved.  I would be curious to know what type of evidence they have ....I know there is some type of video involved but that is all I know ......

     

    That attorney, based on her wording makes it seem like they have a lot more evidence they have gather over the months .....

     

    "IF" that is true and they have quote "a smoking gun", it would be interesting to see if any of the players makes some type of plea to keep this out of the courts.......  just thinking out loud here ......

     

    Of course everyone is presumed innocent until proven guilty and the evidence is made known to their respective lawyers.

    Can't agree more ....

     

    All social media platforms, at its core, are designed to divide people against each other while hiding anonymously behind a keyboard.  Social media platforms discourage 1 on 1 meaningful dialogue and interaction.  Outside of FB, I will NEVER have a X (Twitter) / Instagram or TikTok account.  Even on my FB the only I post about are things about my family and kids and my BBQ.  I never post about work or politics. 

     

    So yeah ...you are spot on... :)

    Never argued against this.  I have a wife and daughter and would be absolutely sicked if this happened  to them ....

     

    However ...this is a hockey forum and as I said above NOT a legal forum.  Discussions will remain on the topic at hand with facts that are already known.  This is not the place to discuss the legaity of NDA's and what was or was not paid out by Hockey Canada.  There are other places on the internet for that.

    He did more than screw with a team .....   "if" the evidence proves otherwise (remember he has yet to be formally charged or tried ...yet) and "if" he is found guilty of what is being reported ....then he screwed his life and the lives of many others outside of hockey.

     

    The Flyers will eventually move on from this but for his life he will pay the repercussions of his actions for years to come. (Again.. if he is found guilty.)

    Before allowing the post I did some research. (Since I am a US Citizen I don't know Canadien Law)

     

    The above mention link is an editorial piece.  Upon further research I came across an editorial by a Canadian Lawfirm explaining your link.   The only Providence so far that has passed any type of regulation for NDA is Priince Edward Island.

    "Before news of the Hockey Canada scandal broke, Prince Edward Island became the first jurisdiction in Canada to enact a law regulating the content and use of NDAs. It prohibits persons alleged to have committed harassment from asking a complainant to enter into an NDA for the purpose of concealing the details of the complaint[5] – except in cases where the complainant wishes to have an NDA."

     

    Note the word regulating...not the word illegal.

     

    In addition the article further states:

     

    "Prince Edward Island is not the only province to consider regulating NDAs. Bills that are almost identical to the Act were introduced in the spring of 2022 in Nova Scotia and Manitoba, but have yet to become law. The Nova Scotia bill passed first reading on April 7, 2022 and has yet to pass second reading.[9] Manitoba’s bill passed first reading on November 29, 2022. It also has not yet passed second reading.[10] In August of 2022, Senator Marilou McPhedran stated she planned to table a federal bill regulating NDAs.[11] More recently, the largest professional association for lawyers in Canada – the Canadian Bar Association (“CBA”) – entered into the discussion on NDAs."

     

    Granted the date of this article in Spring 2023. There could be more updated info. 

     

    Bottom line there was a NDA signed with Hockey Canada.

     

    Moving forward this is a Hockey Forum not a legal Forum.  Please keep comments within the scope of Hockey.  Debates regarding if NDA's are legal or not in Canada can be argued in other parts of the Internet but not here.

    So far only 1 Canadian Providence has passed any type of legislation as listed above.

    Depending how long Briere and company knew this potentially could happen, as posted somewhere else, the NHL simply would not allow a transaction for a player under sometype of criminal investigation.  

     

    I am willing to make an educated guess that the NHL and Flyers organization potentially knew about this for many many months ....

     More pure speculation...but IF that was Cutters reason...could it have nothing to do with Harts guilt or innocence, but rather the Flyers attitude towards the investigation? 

     

    Dont shoot the messenger....just throwing it out there. When you really think about it, a mess like this would not be casually thrown around as a reason to not want to play for a team. It would be guarded and shrouded in secrecy. Kinda makes sense when you think about it....


    Very interesting perspective and thought process here….. gonna have to mull over this one.

    Again, my issue is with how much time has passed. 

     

    There is no statute of limitations in Canada for these types of crimes.  If found guilty there must be consequences.  

    If the situation was reversed and it was your loved one who had this done to them by these players .... would you not want justice to be served?
